Cogema has seen its victory in the US Court of Appeals for the Federal Circuit transferred into action as the US Department of Commerce lifted an import duty on enriched uranium.

The Department of Commerce eliminated the import duty, known as a countervailing duty, that had been applied to low-enriched uranium following two decisions last year that found enrichment to be a service rather than goods and was therefore not subject to the duty.

However, the department is believed to disagree with the court findings and may consider taking the case to the Supreme Court.
