Consultancy/public relations services in relation to global acceptance activities relating to international nuclear services and PNTL shipments.

CONDITIONS FOR PARTICIPATION

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: a) An independent statement proving that the applicant is not bankrupt or being wound up; that its affairs are not being administered by the court; that it has not entered into an arrangement with creditors; it has not suspended business activities or that it is not in any analogous situation arising from a similar procedure under national laws and regulations or that it is not the subject of proceedings for a declaration of bankruptcy, for an order of compulsory winding up or administration by the court for an arrangement with creditors, nor is it the subject of any other similar proceedings under national laws and regulations;

b) An independent statement from the appropriate authority in the country of origin in which the applicant is established to the effect that all obligations relating to the payment of social security contributions have been paid in accordance with the legal provisions of the said country;

c) An independent statement from the appropriate authority in the country of origin in which the applicant is established to the effect that all obligations relating to the payment of taxes in accordance with the legal provisions of the said country;

d) A statement from the applicant that it is willing to enter into a contract under English Law;

e) A statement from the applicant that the applicant or any of its officers is not subject to criminal proceedings in any jurisdiction;

f) A statement from the applicant that, in the past 3 years, it has not had a contract terminated or failed to receive contract renewal on the basis of unsatisfactory performance;

g) Applicant shall confirm that, to the best of its knowledge, it is not in breach of any of the provisions of Regulation 23 of the Public Contracts Regulations 2006 (as amended).

III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: Applicant shall provide audited Company and Parent Company Annual Report & Financial Statements for the previous 2 years plus, if available, the latest interim results. (Where applicable similar information shall be provided for each joint venture/consortium partner) tenderers shall be of acceptable financial strength based on conventional company performance/liquidity ratio analysis that is appropriate for the value of the contract to be awarded and shall not pose a high commercial risk to INS if it were awarded the contract. Minimum level(s) of standards possibly required (if applicable):

III.2.3)Technical capacity

Information and formalities necessary for evaluating if the requirements are met:

a) Applicant to confirm that he is willing to sign a confidentiality agreement in respect of this proposed agreement;

b) Applicant shall provide evidence that they have experience in dealing with political and media issues in the United States, Panama, Caribbean, South America, South Africa, New Zealand and Pacific Island Forum Countries;

c) Applicant to provide evidence of their hazard/risk assessment process;

d) The tenderer shall provide details of their Health and Safety and Environmental Management System or processes (whether documented or not);

e) Provide a copy of applicable ISO 9001:2008 certificate/s or other management system certifications and details of any non conformances noted by the certification body during the last 10 years.

Note: certificate/s to be valid for the duration of the contract. Where a certificate expires within the duration of the contract, an undertaking must be given to provide a copy of the replacement certificate on receipt from the certification body.

Where applicant has no formal third party certification to ISO 9001:2008 (or equivalent) but operates to formal management systems, details of the systems being applied shall be provided for consideration.

f) Outline how the Competency of personnel performing work or providing a service which would affect conformity to requirements is determined, and how the effectiveness of any training given is evaluated
