Exelon-PSEG merger deal with Justice Department

A deal has been reached by Exelon Corp and Public Service Enterprise Group (PSEG) with the Antitrust Division of the United States Department of Justice (DOJ) that resolves all competition issues related to their merger.

Under the terms of the DOJ agreement, Exelon and PSEG will divest fossil-fuel fired electric generating stations with a total capacity of approximately 5600MWe. No divestiture of nuclear capacity or nuclear plants would be required by DOJ, as the increased fossil divestiture will resolve all competition issues.

The merger is expected to complete in the third quarter 2006
